The present Civil Revision Petition is filed under Section 115 of the Code of Civil Procedure, assailing the Order, dated 06.12.2019, in E.P. No. 88 of 2018 in A.R.C. No. 755 of 2011 on the file of the Principal District Judge, Rajahmundry, ordering attachment of the salary of the Petitioner for recovery of the amount due to the first Respondent.

Though, an Order came to be passed by this court on 06.02.2020 staying operation of the Order, dated 06.12.2019, on certain conditions, but, it appears that the same was not complied with due to some error of date in the Order, which is brought to the notice of the court today when the matter is taken up.

Sri. Kuncheam Maheswara Rao, learned Counsel for the Respondent would contend that, since an objection is raised before the Trial Court with regard to the applicability of Section 60 Cr.P.C., the same may be directed to be dealt with by the E.P. court.

Recording the statement made by the learned Counsel for the Respondent, the C.R.P. is disposed of directing the Petitioner to raise the objections before the E.P. court within a period of 10 days from today and thereafter the said Court shall deal the same in accordance with law preferably within a period of four [04] weeks, till

such time, no coercive steps shall be taken for recovery of the amount.

With the above direction, the Civil Revision Petition is disposed of . No order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand closed.
