CRIMINAL PETITION NO.905 OF 2020
ORDER :
This petition is filed under section 482 of Cr.P.C., to quash the proceedings in Crime No.16 of 2020 of Nidadavole Police Station, West Godavari District, registered for the offences punishable under Sections 354, 420, 448, 323 and 506(2) I.P.C, and Section 156(3) Cr.P.C, against the petitioner/A-3, on various grounds.
Learned counsel for the petitioner, after arguing the matter for sometime, requested this Court to direct the police concerned to follow the procedure prescribed under Section 41-A of Cr.P.C.
Acceding to the request of the counsel for petitioner, without touching the merits of the matter, the Criminal Petition is disposed of directing the police concerned to follow the procedure prescribed under Section 41-A Cr.P.C, and the guidelines issued by the Apex Court in Arnesh Kumar v. State of Bihar1 .
Consequently, miscellaneous petitions pending, if any, shall
also stand disposed of.
