THE HON’BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION NO.9919 OF 2019

ORDER :

This writ petition is filed under Article 226 of the Constitution of India to issue Writ of Mandamus to declare the action on the part of the respondent Nos. 3 and 4 in interfering with civil disputes without there being any order or direction from competent civil court and asking the petitioner Nos.1 to 9 sit in the police station hours together and pressuring them to settle civil disputes with the 5^th respondents is arbitrary and violaitve of Articles 14 and 21 of the Constitution of India and consequently direct the respondents 3 and 4 not to interfere with life and liberty of the petitioners.

Though, the learned counsel for the petitioners raised several contentions, there is no need to advert to those allegations, in view of the written instructions placed on record by the learned Government Pleader for Home stating that the respondent Nos. 3 & 4 never interfered with the civil disputes of the petitioners and also never insisted these petitioners to settle the civil disputes pending before the courts.

Recording the submission of the learned Government Pleader for Home, no further adjudication is necessary. However, respondent Nos. 3 & 4 are directed not to call these petitioners to the police station, unless any crime is registered against them.

With the above direction, writ petition is disposed of. No costs.

C onsequently, miscellaneous petitions pending, if any, shall stand closed.
