ORDER :

This Writ Petition, under Article 226 of the Constitution of India, has been filed seeking to declare the action of the respondents, in not implementing the order dated 10.11.2016 passed in O.A.No.2041 of 2016 by Andhra Pradesh Administrative Tribunal, at Hyderabad, as illegal and arbitrary.

Heard learned counsel for petitioner and learned Government Pleader for Services.

Learned counsel for petitioner would submit that, by virtue of the orders dated 10.11.2016 passed in O.A.No.2041 of 2016, the Tribunal has directed the first respondent to conclude the disciplinary proceedings initiated against the petitioner vide G.O.Rt.No.382, Irrigation and Command Area Development (Vigilance-I) Department, dated 30.06.2014, preferably within six months, in terms of the G.O.Ms.No.679 G.A.(Ser.C) Department, dated 01.11.2008. But the respondents did not conclude the enquiry, as directed.

In view of the above, this Court deems it fit to direct the respondents to conclude the enquiry within a period of one month from the date of receipt of this order, failing which, the charge memo issued to the petitioner vide G.O.Rt.No.382

I&CAD(Vigilance-I) Department, dated 30.06.2014, shall stand quashed and, thereafter, the petitioner shall be considered for future promotions.

With the above said direction, this Writ Petition is disposed of. There shall be no order as to costs.

As sequel thereto, miscellaneous petitions pending, if

any, shall stand closed.
