WRIT PETITION No.7435 of 2019

ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, seeking to declare the action of respondents 2 and 3 in not passing orders against the representation of the petitioner, dated 29.04.2019, as bad.

Heard learned counsel for petitioner and heard learned Government Pleader appearing for respondents.

Learned counsel for petitioner submits that the petitioner was working in Police Training Quarters at Ongole, Prakasam District and he sought for transfer to Visakhapatnam city on the ground of his son’s ill-health. By virtue of the orders of the Director General of Police in Rc.No.122/E2/2019, dated 08.12.2019, the petitioner was transferred and posted to Visakhapatnam. But the Commissioner is not permitting the petitioner to join at Visakhapatnam by stating that further orders are necessary from the Unit officers. But the fact remains that the Director General of Police already passed orders, who is superior officer than the unit officer.

The counsel for petitioner further submits that in that regard, the petitioner gave a representation to the 3^rd respondent on 29.04.2019, but the same is kept pending, without any orders.

Hence, in view of the above, this court deems it fit to direct the 3^rd respondent to consider the representation of the petitioner, dated 29.04.2019 and pass appropriate orders, within a period of two (2) weeks, from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, in the writ petition shall stand closed.
