This writ petition under Article 226 of Constitution of India is filed, questioning the inaction on the part of respondents in payment of principal amount of Rs.7,50,000/- and interest amount of Rs.2,60,000/- and declare the same as irregular, unlawful, capricious and totally unjustified, consequently direct the respondents to pay the amount due for supply of the material to the petitioner.

Though the petitioner raised several contentions, but in view of the written instructions, placed on record by learned Assistant Government Pleader for Panchayat Raj, agreeing to pay the amount within short time i.e. after release of budget by the finance department. In view of the submission of learned Assistant Government Pleader for Panchayat Raj, the respondents are directed to clear the dues to the petitioner as claimed in this writ petition, within three months from the date of this order.

With the above directions, the petition is disposed of, without touching the merits of the petition, as to maintainability.
