This petition is filed, under Article 226 of the Constitution of India, seeking to declare the action of the respondents 3 and 4 in not considering the case of the petitioners for regularisation purporting to act as per Clause 6 of Proceedings of the 2^nd respondent in Rc.No.90/PS-1/2010-1, dated 20.07.2017, despite being recommended by the 5^th respondent-Management for absorbing them into aided posts and for release of the Grant-in-Aid against their names and on the other hand, directing the Management to go ahead with fresh recruitment, as illegal and arbitrary.

Heard the counsel for the petitioners and the Government Pleader appearing for respondents 1 to 4.

The counsel for the petitioners submits that by virtue of G.O.Ms.No.41, School Education (PS) Department, dated 30.06.2017, the date for absorption of the unaided approved eligible candidates was fixed as 23.09.2002. There was a one time measure to absorb the unaided (approved) eligible candidates, which was to be taken up on 23.09.2002. The GO fixing the cut off date is G.O.Ms.No.75, School Education (PS-2) Department, dated 23.09.2002. 04.12.2006. The counsel also submits that this matter is covered by the order in W.P.No.11170 of 2019. The court in the said order after considering the submissions of the petitioner’s counsel therein directed the respondents to dispose of the representations given by the petitioner in that regard. In this case also the petitioners submitted a representation, dated 07.08.2017.

Hence, in the light of the submissions of the petitioners’ counsel, this court deems it fit to direct respondents 1 to 4 to consider the representation made by the petitioners on 07.08.2017 to the District Educational Officer, Kadapa, and to pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.

With the above observations, the Writ Petition is disposed of. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
