The petitioner-society seeking Writ of Mandamus , declaring the action of respondent Nos.2 to 4, particularly, the 4^th respondent in insisting the petitioner to close down the passage gate onto the public road (donka poramboke) in S.Nos.224 and 224/1 situated in front of Satya Sai Educational Society of Kothacheruvu Revenue Village, Kothacheruvu Mandal, Ananthapur District, as illegal and arbitrary and for consequential direction.

Learned Government Pleader for Revenue takes notice on behalf of the respondents.

When the matter is taken up for hearing, learned counsel for the petitioner would submit that in front of the educational society of the petitioner, there is a strip of land in an extent of Ac.0.08 cents, which is being used by the petitioner-society for ingress and egress to their educational society and admittedly, the said land belongs to the Government, and in fact on 28.04.2018, the petitioner-society made a representation to the 4^th requesting him to assign the said extent of land for the use of the petitioner-society, but no order was passed so far.

Refuting the same, learned Government Pleader would submit that no such representation was given by the petitioner and if a representation is made, the same will be considered as per law.

In that view of the matter, this writ petition is disposed of directing the petitioner-society to make a fresh representation requesting to assign about Ac.0.08 cents of strip of land lying in front of the petitioner-society within two weeks from the date of receipt of a copy of this order. In which case, the respondents shall consider the said representation and pass order in accordance with law and communicate to the petitioner-society within four weeks from the date of receipt of such representation. Till such exercise is completed, the respondent authorities shall not prevent the petitioner-society from using the subject land. No order as to costs.
