ORDER:

This writ petition is filed under Article 226 of the Constitution

of India, seeking to issue a writ of Mandamus directing the 2^nd respondent to release the petitioner’s lorry bearing No.AP 16 TY 4994 along with 15 ton of rice

Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents.

The case of the petitioner is that he is the owner of the lorry bearing No.AP 16 TY 4994. On 10.06.2019 the 4^th respondent seized the stock of 15 tons of rice being transported in the lorry bearing No.AP 16 TY 4994 under the cover of Police Proceedings holding that the seized rice was PDS rice.

Learned counsel for the petitioner submits that the subject matter of the writ petition is squarely covered by the order dated 27.09.2019 passed in WP No.8085 of 2019 by this Court and sought for passing similar order in this writ petition.

Learned Government Pleader for Civil Supplies appearing for respondent did not oppose for passing the similar order in this writ petition.

Considering the submissions of both the counsel, this writ petition is disposed of in terms of WP No.8052 of 2019 directing the 2^nd respondent to release the seized stock of rice to the petitioner and lorry bearing No.AP 16 TY 4994 subject to the condition of the petitioner furnishing any nationalized bank’s guarantee equivalent to 50% of the value of the rice and the value of the lorry to be determined by the 2^nd respondent within one week form the date of receipt of the copy of this order.

With the above observations, the writ petition is disposed of. No costs. Miscellaneous petitions pending if any, shall stand closed.
