ORDER:

This Civil Revision Petition is filed assailing the order dated17.09.2018 by virtue of which the learned Senior Civil Judge, Gudur dismissed I.A.No.653 of 2018 in O.S.No.39 of 2013 filed by the petitioner/first defendant under Order 7 Rule 14 CPC seeking to condone the delay in filing documents.

Heard learned Counsel for the petitioner and learned Counsel for the respondents.

The order of the lower Court shows that the Court considered that the petitioner/first defendant failed to explain as to how the documents sought to be filed are useful and the petitioner did not mention about the relevancy of the documents. The Court observed that the petitioner did not mention how he obtained the documents without permission of three member committee appointed by the Honourable High Court.

The petitioner’s counsel submits that the order of the Honourable High Court is dated 25.1.2018 and that the documents sought to be filed now are prior to the said date. With regard to relevancy of the documents, learned Counsel submits that the documents go to show that the petitioner is working as President of the institution which fact is not disputed by the respondents.

Hence, this Court find some force in the contentions of the petitioner that the documents sought to be marked are necessary for the adjudication of the issues involved in the suit.

In the result, the Civil Revision Petition is allowed and the order under revision is set aside. However, considering the facts and circumstances of the case, the lower Court is directed to dispose of the suit as expeditiously as possible.

Miscellaneous petitions pending consideration if any in the Civil Revision petition shall stand closed. No order as to costs.
