In the present revision, filed under Section 115 of the Code of Civil Procedure, 1908, challenge is to the order, dated 08.02.2019, passed by the learned III Additional Junior Civil Judge, Guntur in E.P.No.132 of 2019 in A.O.P.No.224 of 2018.

By way of the order under challenge, the learned Additional Junior Civil Judge ordered attachment of the salary of the petitioner herein. This Court, on 04.09.2019, in I.A.No.01 of 2019, directed the petitioner/judgment-debtor No.2 to deposit Rs.50,000/- to the credit of E.P.No.132 of 2019.

It is stated, at the hearing, that the petitioner herein deposited the said amount. Having regard to the consensus expressed by the learned counsel for the petitioner and the learned counsel for the respondents, the following order is passed:

“Civil Revision Petition is disposed of and the petitioner herein shall pay the amount due in four equal monthly instalments. The first instalment shall be paid on or before 12.12.2019, the second instalment shall be paid on or before 12.01.2020, the third instalment shall be paid on or before

12.02.2020 and the fourth/last instalment shall be paid on or before 12.03.2020. It is made clear that, in the event of default in payment of any one of the instalments, this order would not enure to the benefit of the petitioner herein and the first respondent-decree-holder is entitled to proceed in accordance with law. It is also made clear that the first respondent-decree-holder is entitled to withdraw the amount deposited by the petitioner herein, pursuant to the order, dated 04.09.2019. There shall be no order as to costs”.

As a sequel thereto, miscellaneous petitions, pending, if

any, shall stand closed.
