Heard Shri Nagendra Pratap Singh, learned counsel for the petitioner as well as learned Standing Counsel for respondents no. 1 to 4 and Shri Ashok Kumar Singh, who has filed his Vakalatnama on behalf of respondent no.5, which is taken on record.

It has been submitted by learned counsel for the petitioner that an application under Section 80 of the U.P. Revenue Code was preferred by the respondent no.5 before the Sub Divisional Magistrate, with regard to the property situated at Gata No. 537/0.162 hectare out of 0.185 hectare, situated at Village Colonelganj, Pargana Gwarich, Tehsil Colonelganj, District Gonda. It was stated that it was on the disputed land that opposite party no.5 has constructed a house and was conducting non-agricultural activities.

It is in the aforesaid circumstances, the application under Section 80 of the U.P. Revenue Code was allowed by the Sub Divisional Magistrate, Colonelganj, District Gonda by means of order dated 11.04.2025. Against which, the petitioner has filed an appeal before the Additional Commissioner (Administrative)-II, Devi Patan Mandal, Gonda. The said appeal has been admitted for hearing but with regard to the application for interim relief, it was noticed that in another appeal pending before the Additional Commissioner (Administrative)-II, orders for status-quo have already been passed and therefore, there would not be any necessity of

passing separate orders in the appeal preferred by the petitioner.

It is further stated by the petitioner that with regard to the disputed property, suit of partition pending before the Sub Divisional Magistrate, Collonelganj, District Gonda and against the order dated 21.8.2024 an appeal was preferred by the petitioner, which is also pending before the Additional Commissioner (Administration)-II, Devi Patan Mandal, Gonda, where the parties were directed to maintain status-quo on the disputed land.

It is in the aforesaid circumstances, it is noticed that the orders for maintenance of status-quo already existing in Case No. 594 of 2025, preferred by the petitioner and accordingly, it is for the said reason that in Case No. 761 of 2025, the Additional Commissioner has held that in the said order would cover the case of the petitioner and no separate order is required.

Counsel for the private respondent has informed this Court that the matter has already been argued on merits on 09.01.2026. The certified copy only discloses that the matter has been argued on merits but does not disclose that the judgment has been reserved.

Counsel for the respondent no.5 has fairly submitted that even the W.S., has not been filed by him, accordingly, it can safely be concluded that the proceedings are still pending before the appellate authority.

In light of the above, without interfering in the impugned order dated 6.8.2025, the appellant authority is directed to conclude the proceedings of appeal no. 761 of 2025 within the next three months. Counsel for the respondent no.5 undertakes to file his written objections within next two weeks and the parties further undertake to cooperate in the proceedings before the appellate authority and shall not take any unnecessary adjournments.

Considering the fact that interim order has already been passed in parallel proceedings, which is pending consideration and consequently the parties shall maintain status-quo as already provided for in the order dated 07.04.2025 in Case No. 594 of 2024, till the matter is concluded by
