Supplementary affidavit filed today is taken on record. The urgency application dated 04.02.2026, morefully annexed as Annexure No. 1 to the supplementary affidavit dated 05.06.2026.

Heard learned counsel for the petitioner and learned standing counsel for the State-respondent nos. 1 to 3.

Notice to respondent nos. 4 to 9 is dispensed with.

The contention of learned counsel for the petitioner is that the petitioner has filed a petition under Section 5-A of the Societies Registration Act, 1860 seeking permission to raise the requisite funds to furnish the bank guarantee required by the National Medical Commission by creating a mortgage over its immovable properties.

It is contended that in the said proceedings, the private respondents have filed their no objection and only a formal objection has been raised by the State. It is further contended that the petitioner has completed establishment of the institution with an intake capacity of 150 MBBS students and inspection by the National Medical Commission may be conducted at any time.

It is submitted that upon successful completion of the inspection, the petitioner would also be required to furnish a bank guarantee of Rs. 25

crores to the National Medical Commission. For furnishing the said bank guarantee, the petitioner is required to mortgage its immovable properties, for which the required permission has been sought from the learned District Judge.

It is further submitted that, in the event the petitioner fails to furnish the requisite bank guarantee and comply with the formalities prescribed by the National Medical Commission, the petitioner would be unable to secure the necessary permission from the Commission and, consequently, the institution would not be able to commence functioning from the academic session 2026–27.

It is further submitted that in the petition is pending before the learned District Judge, the pleadings between the parties have already been exchanged and the petitioner-society has only to submit it's renewal certificate.

Under the aforesaid circumstances, the petitioner has moved an application before the learned District Judge under Section 15 of the Bengal, Agra and Assam Civil Courts Act, 1887, seeking urgent hearing of the matter during the summer vacation. It has further been informed that the said application is listed before the learned District Judge on 08.06.2026.

Accordingly, the present writ petition is disposed of with a direction to the learned District Judge to consider and decide the aforesaid application of the petitioner, if possible, on the next date fixed, i.e., 08.06.2026, or within three days thereafter, keeping in view the urgency shown by the petitioner.

Office is directed to provide a certified copy of this order to the learned counsel for the petitioner within 24 hours.
