This is a writ petition under Article 226 of the Constitution of India wherein the writ petitioner has prayed for the following substantial relief(s):

"[I] Issue a writ, order or direction in the nature of Certiorari thereby quashing the impugned demolition order if any passed under UP Revenue Code, 2006 after summoning to the same in original.

[II] Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the opposite parties not to further demolish the house as well as trees which were exist over the land of the petitioner, during the pendency of the present writ petition."

Learned counsel for the State submits that the complaints have been received against the petitioner and upon such complaints, the authorities have acted and removed the encroachment that had been carried out by the petitioner. With regard to the house that has been built by the petitioner, proceedings under Section 67 of the U.P. Revenue Code, 2006 has been initiated against him. He further submits that no further demolition shall take place until the order under Section 67 of the U.P.

In view of the undertaking given by learned counsel for the State, the petitioner is directed to participate in the proceedings under Section 67 of the U.P. Revenue Code, 2006 that is listed on 4th June, 2026.

With the above directions, the writ petition is disposed of.
