Heard Shri Rajesh Kumar Verma, learned counsel for the petitioners and learned Standing Counsel for the respondents no. 1 & 2 and Shri Yusuf Safi, Advocate, holding brief of Shri Aftab Ahmad, learned counsel for the respondents 3 and 4.

It has been submitted that the petitioner is recorded tenure holder on the land situated on Gata No. 16 area 0.044 hectare situated in Village Badhel, Pargana and Tahsil Nawabganj, District Barabanki on which respondents no. 3 and 4 have constructed a road. It has been submitted that neither the land has been acquired by the respondent nor any compensation has been paid to the petitioners.

In the aforesaid circumstances, a prayer has been made to pay compensation to the petitioners for acquiring the aforesaid land.

After arguing the matter at some length, learned counsel for the petitioners submits that the grievances of the petitioners will be substantially redressed in case respondent no. 2 i.e. District Magistrate, District Barabanki is directed to consider and decide the representation of the petitioners in this regard.

Learned counsel for the respondents do not oppose the aforesaid prayer.

Accordingly, the writ petition is disposed of with a direction to the respondent no. 2 to have a demarcation proceedings conducted under Section 24 of the U.P. Revenue Code, 2006 to ascertain whether the road

has in fact been constructed on the land of the petitioners and after obtaining report in this regard proceed to pass appropriate order on the representation of the petitioners dated 13.3.2026, a copy of which is annexure 7 to the writ petition, with an expedition.

Let a decision be taken by him expeditiously within a period of three months from the date of receipt of a certified copy of this order in accordance with law and communicate the same to the petitioners forthwith.
