After hearing the parties what comes out is that the petitioner claims to be in possession of part of the land in question over which he has a shop and this was the subject matter in issue in arbitration proceedings which culminated in an award, and ultimately, a suit was preferred in respect of the same land which was ultimately decreed in terms of the award referred hereinabove, a copy of which is on record.

The petitioner claims to be in possession and that is how electricity connection was granted to him by the Electricity Department. However, on some complaint, the same has been cancelled only on the ground that the petitioner could not show ownership documents, whereas the petitioner says that he has annexed documents with this petition which were also shown before the concerned authorities but they cancelled the electricity connection arbitrarily.

We are of the opinion that electricity connection must have been granted after on the spot inspection and verifying the possession of the petitioner and it could not have been cancelled in this manner. We, therefore, direct the concerned opposite parties as an interim

measure to restore the electricity connection of the petitioner, forthwith, without prejudice to the right, title, if any, claimed over the land or shop in question, by any other private person, meaning thereby, mere grant of electricity connection or its restoration or for that matter this order, will have no bearing on any such right being claimed by any third party.

Let pleadings be exchanged between the parties within a period of six weeks.

We, further, make it clear that our order shall also not confer any right on the petitioner, if he has occupied any land in excess of what he was entitled to under the aforesaid award etc.
