4. Learned counsel for the Jal Sansthan says that the petitioner's premises, which is a commercial complex, is situated within 100 meters radius as prescribed in Section 55-b(i) of the U.P. Water Supply and Sewerage Act, 1975 read with Rule 2 of the Jal Sansthan (Radius Regarding Levy of Water Tax) Rules, 1993. The houses situated adjacent or nearby are being provided water supply and they are also paying water tax.

5. Let an affidavit be filed by the opposite parties in response to the writ petition within a period of three weeks annexing therewith relevant documents/ proofs in support of the aforesaid assertion.
