Heard Shri Vijay Prakash Srivastava appearing on behalf of he petitioners, learned Standing Counsel appearing on behalf of the respondent nos.1 and 2.

Learned counsel for the petitioners submits that an application under section 117 of the U.P. Revenue Code, 2006 was given by the private respondents on the basis of which Kurra reports were prepared and by means of an order dated 02.07.2024, the land was partitioned by the Sub Divisional Magistrate, Devipatan, District Behraich, Tehsil Mahsi. The petitioners came to know about the same only when the partition proceedings were being carried out and they had filed an appeal before the Additional Commissioner, Administration, which has also been rejected on 12.12.2024

Learned counsel for the petitioners further submits that notice has never been served by the trial court and on this aspect of the matter, the appellate authority has also not considered this fact while rejecting the appeal preferred by the petitioners.

Accordingly, the matter requires consideration.

Issue notice to respondent nos. 3 to 20.

List this case on 06.04.2026.

Till the next date of listing, the status quo over the land in dispute shall be maintained by the parties, as it exists today.
