Heard learned counsel for the petitioner and learned Standing Counsel for the State.

The present petition has been filed in the nature of certiorari to quash the impugned order dated 28.2.2026, whereby the petitioner's financial and administrative power has been suspended by the District Magistrate.

Learned counsel for the petitioner submits that the petitioner is a village Pradhan and District Magistrate without taking into consideration the reply submitted by the petitioner in response to the show cause notice, mechanically and in motivated manner suspended the petitioner's financial and administrative power. The Deputy Commissioner Labour Employment is not competent to inquire the matter preliminary because it is well settled law that only the District Panchayat Raj Officer is competent to conduct the preliminary enquiry under the Rule 1997.

Learned Standing Counsel for the State is granted four weeks time to file counter affidavit. Rejoinder affidavit, if any, may be filed within two weeks thereafter.
