Heard Shri Indra Pratap Singh, learned counsel for the petitioner as well as learned Standing Counsel for respondents no. 1, 2 and 3 and Shri Pankaj Gupta for respondent no.4.

It has been submitted by counsel for the petitioner that the present dispute pertains to the land situated at Gata No. 991 M./0.55 hectare, which was initially recorded in the name of Jawahar.

It has been submitted that on the death of Jawahar, the land came to be recorded in the name of Prakash, who also died and subsequently the name of Sursati (Sursata) D/o Prakash was entered into the revenue records. Sursati (Sursata) also died leaving behind Shivpata as her daughter, while the petitioner Durga Prasad, son of Shivpata and claimed to be only successor to the disputed property.

It has further been submitted that during the mutation proceedings statement of Sursati (Sursata) was duly recorded but before any order could be passed, she had died and subsequently on the reference being made by the Deputy Director of Consolidation was decided exparte. Despite service, no one had appeared on behalf of the petitioner.

It has further been stated that even the application for recall of the order dated 24.10.2008 has been rejected by the Deputy Director of Consolidation, by means of the impugned order dated 19.08.2025, on the

ground of delay.

The petitioner submitted that the delay was duly explained before the Deputy Director of Consolidation but still he proceeded to reject the application for condonation of delay.

Accordingly, the matter requires consideration.

Issue notice to respondents no. 5 and 6 returnable at an early date.

List on 09.03.2026.

Till the next date of listing, the parties are directed to maintain statusquo, as is existing today.
