Heard Sri Sharda Prasad Mishra, learned counsel for the petitioner and learned Standing Counsel for the respondent nos.1 to 4. Sri Avinash Chandra Srivastava has accepted notice on behalf of respondent no.5.

The present writ petition has been filed challenging the order of the Board of Revenue, Circuit Court, Agra, the respondent no.3, dated 8.1.2026, by which the records of Case No.T202501010106940 pending before the Deputy District Magistrate, Tehsil Sadar, District Agra under Section 134 of the U.P. Revenue Code, 2006 has been summoned.

It is contended by learned counsel for the petitioner that the petitioner has filed a suit for ejectment of the defendants occupying his land without title under Section 134 of the Code in which an interim order was passed. The said order was being extended from time to time. However, in a revision having been filed by the respondent no.11, the entire records of the suit have been summoned, as such, the interim order could not be extended. It is further contended that the aforesaid revision has been filed against an interlocutory order, which is not maintainable.

I have considered the submissions made by learned counsel for the parties and perused the record.

Learned counsel for the petitioner further states that the petitioner after coming to know of the order dated 8.1.2026 has not appeared before the Board of Revenue on 11.3.2026, the date fixed in the matter.

As the maintainability of the revision No. 21 of 2026 against the interlocutory order is being objected by the petitioner, no useful purpose would be served in keeping the writ petition pending by issuing notices to the contesting respondents, as the said issue can be decided by the respondent no.3 itself.

In view of the aforesaid, the present writ petition is disposed of with liberty to the petitioner to move an appropriate application before the respondent no.3 challenging the maintainability of the aforesaid revision filed against the order dated 6.12.2025. If any such application is filed by the petitioner within 15 days from today, it shall be decided by respondent no.3, positively, within a further period of two months thereafter.

Till the disposal of the objection of the petitioner, all the parties are directed to maintain the status quo regarding the nature and possession of the land in dispute.
