Heard Mr. Hari Prasad Gupta, learned counsel for petitioner and Mr. Jogendra Nath Verma, learned State Counsel for opposite parties.

Petition has been filed seeking following main reliefs:

"(i) Issue a writ, order or direction in the nature of CERTIORARI quashing the impugned order dated 12.04.2024 (contain as annexure no.1 to the writ petition upto the instant of payment of interest of Rs.155763/-instead of 719291.50/-.

(ii). Issue a writ, order or direction in the nature of MANDAMUS commanding the opposite parties to count and pay the month wise interest on arrears of the salary of the petitioner form 05.07.2003 to 22.09.2008 as per direction of this Hon'ble Court @ 6% from the dated of due till the dated of actual payment.

(iii). Issue a writ, order or direction in the nature of MANDAMUS commanding the opposite parties to pay the interest on delayed payment on difference of salary of 23.09.2008 to 30.06.2023 paid on 21.07.2023 in the bank account of the petitioner.

(iv). Issue a writ, order or direction in the nature of MANDAMUS commanding the opposite parties to conduct the enquiry and take

appropriate action against the person/authority who has committed illegality anomaly and fraud in appointment and payment of the arrears of the salary with interest to the petitioner."

Learned State counsel has raised a preliminary objection regarding maintainable of this petition in view of the fact that in the earlier rounds of litigation in Writ A No.20914 of 2014 as well as Writ A No.8975 of 2023, only arrears of salary for the period 05.07.2003 till 22.09.2008 had been granted alongwith interest at the rate of 6% per annum whereas by means of present writ petition, petitioner is seeking compound interest as well as interest from 23.09.2008 till 30.06.2023.

It is therefore submitted that by means of the present writ petition, petitioner is seeking modification/review of judgments passed earlier which is impermissible.

In view of such preliminary objection being raised, learned counsel for petitioner on the basis of instruction seeks to withdraw the writ petition with liberty to file review/modification of the aforesaid judgments.

Considering such submissions, writ petition is dismissed as not pressed granting the aforesaid liberty.
