Learned counsel for the petitioner submits that on the basis of complaints made by the petitioner and the Incharge Head Master against each other, no action has been taken against the Incharge Head Master, whereas the petitioner has been placed under suspension. He further submits that the charges levelled against the petitioner are not of such a serious nature as to warrant the imposition of a major penalty. He further submits that the impugned order of suspension is in violation of Rule 4 of the U.P. Government Servant (Discipline and Appeal) Rules, 1999 and, therefore, the same is liable to be quashed.

Mr. Ashok Kumar Singh, learned counsel for respondent-BSA prays for and is granted a week's time to obtain instructions in the matter, as to the outcome of the complaint made by the petitioner as well as other allegations mentioned in the suspension order.
