Heard learned counsel for petitioner and learned State Counsel for opposite parties.

Present petition has been filed with the following prayers:-

i) Issue a writ, order or direction in the nature of Mandamus commanding the opposite parties, especially opposite party no.2, to grant/sanction the Family Pension to the petitioner w.e.f. 1-8-2017, in the light of the provision of Government orders dated 5-12-2011 and 23-12-2016 as well as the order dated 2-5-2023, the photo copy of which are annexed as Annexure Nos. 3, 4 and 13 to the writ petition.

ii) Issue a writ, order or direction in the nature of Mandamus commanding the opposite parties to grant arrears of Family Pension to the petitioner w.e.f. 1-8-2017 along with the interest at the rate of 10% per annum, w.c.f. 1-8-2017 till the date of actual payment.

iii) Issue any other order or direction which this Hon'ble Court may deem, fit and proper in the circumstances of the case, may also be passed in favour of the petitioner.

Contention of learned counsel for the petitioner is that despite the fact that the Contributory Provident Fund and other retiral dues like Gratuity and Leave Encashment have been paid, the petitioner has not been granted family pension.

He argues that persons similarly situated have been extended the benefit

of family pension and takes the example of Ms. Vimla Pal who has been granted the family pension. He also places reliance on the Government Orders dated 05.12.2011 and 23.12.2016 showing the entitlement of the petitioner for family pension.

Considering the fact that the petitioner has already represented before respondent no. 2 by filing an appropriate application, the present petition is disposed off permitting the petitioner to file a fresh application before respondent no.2 who shall take a decision thereupon in the light of the submissions of the petitioner within a period of six weeks from the date of filing of the application.
