Co-coordinator under the National Tuberculosis Elimination Programme (NTEP) in the office of the Chief Medical Officer, Shamli, challenged the transfer order dated 12.03.2026 passed by respondent No.4/CMO, Shamli directing him to join the District Tuberculosis Center, Mahavatpur Hind, Shamli, contending that the post is non-transferable and the order is per se illegal; reliance was placed on an order dated 24.02.2026 of this Court in Writ C No.2753 of 2026 wherein a transfer order was quashed. It is argued by learned counsel for the petitioner that the petitoner was appointed in the office of Chief Medical Officer, Shamli on the post of T.B.- H.I.V. Co-coordinator under the National Tuberculosis Elimination Programme (NTEP) in District Shamli in the year 2015. Pursuant to the aforesaid, the petitioner joined his services on the aforesaid post in the Office of Chief Medical Officer, Shamli on contract basis. It is argued that since then, the petitioner is working on the aforesaid post and the aforesaid post is non-transferable post. It is argued that despite the aforesaid, the respondent No.4/Chief Medical Officer, Shamli passed order dated 12.03.2026 directed the petitioner to join District Tuberculosis Center, Mahavatpur Hind Shamli which is per se illegal and the same is liable to be set aside. Learned counsel for the petitioner placed reliance upon the order dated 24.02.2026 passed by this Court in Writ C No.2753 of 2026 and argued that in the aforesaid case, the transfer order has been quashed.

Learned Standing Counsel prays for and is granted time till 07.04.2026 to seek Instructions that why the transfer order may not be quashed.
