Heard learned counsel for the petitioner, learned Standing Counsel, and perused the record.

It is submitted that the respondent no. 2 has illegally declared the appointment of the petitioner as null and void, whereas he lacks jurisdiction to do the same. It is further submitted that the present petitioner was superannuated on 31 August 2025, and after about eight months of his retirement, the District Inspector of Schools (D.I.O.S.) has illegally declared his appointment as void ab initio. In support of his submission learned Senior counsel has placed reliance upon the judgments of this Court in Ravindra Singh Rathore vs. District Inspector of Schools, Etawah and Others, 2004 (1) AWC 310; Dr. R.B. Agnihotri vs. State of U.P. and Others, 2000 (2) ESC 915 (All.) and Smt. Sheela Sharma vs. State of U.P. and Others, 2014 (14) ADJ 639.

Learned Standing Counsel has prayed for and is granted three weeks' time to address the court on the aforesaid points.
