Shivendra Singh and 32 Others vs State of U.P. Thru. the Secy. Deptt. of Medical Health and Family Welfare Lko. and 10 Others

This petition has been filed seeking mandamus commanding the respondents to reinstate the petitioners on the post of security guard at their place of posting and to pay them regular monthly wages and arrears of salary from the date of removal till the date of actual reinstatement. A further direction has been sought to direct the respondents to adjust them on the post of security guard at their place of posting. A prayer for deciding their representation has also been sought.

Learned counsel for the petitioners submits that the petitioners were engaged by respondent no. 11-M/s. Jeet Security Services, Prayagraj and they were discharging their duties on the said post under the control of respondent no. 2- Chief Medical Officer, Sitapur at different Community Health Centers at Sitapur as well as District Women hospital, Sitapur. It is submitted that the petitioners have been stopped from working by the respondents-officials on the ground that the contract period of their service provider has already been lapsed, however, 28 persons are still being allowed to work till today, though under some other security agency. Submission of the learned counsel for the petitioners is that the

petitioners may also be allowed to work, as those 28 persons are being allowed to discharge their duties.

Learned Additional Chief Standing Counsel submits that as per guidelines, security guards have to be provided only from Uttar Pradesh Poorva Sainik Kalyan Nigam. He further submits that 28 persons, who are working, will also be replaced from the guards to be sent by Uttar Pradesh Poorva Sainik Kalyan Nigam.

In the meantime, Chief Medical Officer, Sitapur is directed to place the comprehensive written instructions stating therein that whether any Security Agency other than the Uttar Pradesh Poorva Sainik Kalyan Nigam was engaged to provide the security guards.
