Heard Sri Ram Mohan, learned counsel for the petitioner, learned Standing Counsel for the respondent nos.1 to 4 and Sri Krishna Kant Singh, learned counsel for the respondent no.5.

The present writ petition has been filed seeking a direction to the respondent authorities to remove the illegal encroachment made by private respondents over Plot No.452-Sa, area 0.154 hectare, recorded as Sadak in the relevant revenue records, relating to Village Nagla Kanhi, Achalpur, Gram Panchayat Siyn, Tehsil and District Etah.

In pursuance of the direction of this Court, learned Standing Counsel has placed before the Court the instructions dated 2.12.2025 sent by Deputy District Magistrate, Tehsil and District Etah, which is taken on record.

Perusal of the aforesaid instructions shows that Plot No.452-Sa is recorded as Pathway in Khatauni 1430 01435 Fasli. In pursuance to the complaint made by petitioner, the revenue team visited the spot for demarcation of Plot No.452-Sa. After said demarcation over the said plot, soil work was directed to be carried out. Necessary approval has been granted for the soil work under the MGNREGA scheme. However, due to rain and the plot being covered with water, immediate action could not be taken. At present soil work is going on over the aforesaid plot to fill up the Pathway, which shall be completed within a month.

In view of the aforesaid instructions, it is evident that the Pathway over

the aforesaid plot is being restored under the MGNREGA scheme, as such, no further direction is required to be issued by this Court in the present petition. No useful purpose would be served in keeping the writ petition pending, as such, it is accordingly dismissed as infructuous.
