Heard learned counsel for the petitioner, Mr. Mridul Kumar, learned Standing Counsel for the State-respondents and Mr. Hari Narayan Singh, learned counsel for the gaon sabha.

Learned counsel for the petitioner submitted that private respondents are in illegal possession of the plot in question as such appropriate action be taken against the private respondent Nos.4 to 14.

Instruction dated 14.1.2026 sent by Sub Divisional Officer, Takha, Etawah is taken on record.

Mr. Mridul Kumar, learned Standing Counsel for the State-respondents on the basis of the instruction submitted that plot No.785 is recorded as khalihan in the revenue record. He further submitted that plot in question is being used as abadi as such proceeding under Section 67 of U.P.Revenue Code, 2006 cannot be initiated in the matter.
