1. Heard.

2. By means of this writ petition, the petitioner has prayed for the following main relief (s):-

"(i) Issue a writ of Certiorari for quashing the impugned order dated 16.01.2026 passed by Responent No.3 (Sub Divisional Officer, TehsilMahmudabad, District- Sitapur).

(ii) Issue a writ of Mandamus directing the authorities to construct the Annpurna Bhawan on Gata No. 1128 as per the LMC resolution dated 22.12.2025."

3 . The petitioner is aggrieved by the proposed construction of 'Annapurna Bhawan' on a piece of land, which according to him is different to a land proposed by the Gaon Sabha by its resolution dated 22.12.2025.

4. The Gaon Sabha has not come to Court though, it could have come, if aggrieved.

5. Ms. Akansha Dubey, learned Additional Chief Standing Counsel has written instructions to the effect that signatures of the secretary of the Gram Panchayat on the alleged resolution being relied upon by the petitioner are forged. No such resolution was ever approved by the S.D.M. In fact in a meeting headed by the District Magistrate/Collector of the district, it was decided to construct 800

Annapurna Bhawan throughout the district including the one at hand. After receipt of representation of the petitioner and other villagers, the matter was re-considered, a joint inspection was done and, thereafter, it was found that the land on which it is proposed to be constructed is best suited from all angles.

Looking into the fact that only one person has approached this Court, but without expressing any opinion on merits, as the Gaon Sabha has not approached this Court, we see no reason to interfere the matter at the behest of the petitioner, specially, as, essentially it is a matter to be seen by the authorities.
