Heard Shri Ram Sewak, the learned counsel for the petitioner, Shri Anil Kumar Kushwaha, the learned Standing Counsel for the State of U.P. and Shri Mohan Singh, the learned counsel for the Gaon Sabha.

By means of the instant petition filed under Article 226 of the Constitution of India, the petitioner has sought issuance of a direction for removal of encroachment made by the respondent No.6 on pond land bearing Gata No.805 Kha measuring 0.0820 Hectare, land reserved for Mela bearing Gata No.806 measuring 0.2020 Hectare and Devsthan land bearing Gata No.807 measuring 0.0130 Hectare situated in Village- Balli Kirpalpur, Sonauragaupur, Tehsil- Bikapur, District- Faizabad/Ayodhya.

On the basis of written instructions, learned counsel for the Gaon Sabha has stated that land bearing Gata No.805 Ka and 805 Kha are minjumla numbers, proceedings for partition and demarcation under Section 30 (2) of U.P. Revenue Code, 2006 have already been instituted. No encroachment has been found over other lands bearing Gata Nos.806 and 807.

In view of the statement made by the learned Standing Counsel for Gaon Sabha on the basis of written instructions, the present

petition is disposed off by issuing a direction that the proceedings instituted for partition and demarcation of land bearing Gata Nos.805 ka and 805 Kha situated in Village- Balli Kirpalpur, Sonauragaupur, Tehsil- Bikapur, District- Faizabad/Ayodhya shall be concluded expeditiously, in accordance with law and, thereafter, in case any encroachment is found on any portion of public land, removal of encroachment be ensured in accordance with law.
