Heard Sri Rajeev Chaddha, learned counsel for the applicant, Sri Bade Lal Bind, learned counsel for the State and perused the material brought on record.

The present transfer application under Section 447 BNSS has been filed by the applicant- Shri Niwas Chaudhary, with the prayer to transfer the proceedings in Session Trial No. 38 of 2007 (State Vs. Shri Niwas Chaudhary) arising out of Case Crime No. 23 of 2005, under Sections 409, 420, 467, 468, 471, 109, 120-B I.P.C. & 13 (1) of Prevention of Corruption Act, Police Station Tarabganj, District Gonda, pending in the Court of Special Judge (P.C. Act)-V, Gorakhpur, with a further prayer that proceeding of the aforesaid case be stayed during the pendency of the present transfer application.

Learned counsel for the applicant submits that the present transfer application has rendered infructuous as the case has already been transferred under the orders of learned District & Sessions Judge concerned and as such be dismissed as infructuous.

As prayed, the present transfer application is dismissed as infructuous.
