Priyanka Devi and another vs Satyendra Kumar

The present application under Section 24 of C.P.C. has been preferred by the applicants for transfer of Case No. 1673 of 2025 (Satyendra Kumar Versus Priyanka Devi) under Section 9 of Hindu Marriage Act, pending before the Court of Principal Judge, Family Court, Lucknow, to the Court of Principal Judge, Family Court, Unnao.

The contention of the learned counsel for the applicants is that the marriage of applicant No.1 was solemnized with the opposite party on 02.05.2021 according to Hindu rites and rituals at Unnao. It is alleged that after marriage, the opposite party and his family members physically and mentally tortured applicant No.1 due to non-fulfilment of additional demand of dowry and several times brutally beaten her. The allegation as levelled by the applicants is that in the month of May, 2023, the opposite party and his family members ousted the applicant from their house with the threatening that till such time a four wheeler is not provided by her parents, she will not be allowed to enter the matrimonial house.

It is contended on behalf of the applicants that applicant No.1 along with her minor daughter (applicant No.2) aged about four and a half years, is residing at Unnao with her old aged parents who have insufficient source of income. The submission of the learned counsel for the applicants is that the applicants have no independent source of livelihood and it would be very hard and difficult for her to pursue the case at Lucknow while residing at

Unnao, especially with a baby girl and no other person in the family to escort her from Unnao to Lucknow.

It is further submitted that since the relations between the applicant and opposite party are not cordial, there is a serious threat to life in attending the Court at Lucknow and it would be extremely unsafe for her to frequently travel from Unnao to Lucknow to regularly attend the proceedings of the case on each and every date. It is also submitted on behalf of the applicant that a case under Section 144 B.N.S.S. for maintenance having Case No. 1608 of 2025 against the opposite party is pending before the Court of learned Principal Judge, Family Court, Unnao.

Let notice be issued to the opposite party, both ways i.e., by regular mode as well as dasti .

Steps for service of notice be taken within seven working days.

In case the steps for service of notice are taken within the aforesaid period, Office shall provide dasti notice to the learned counsel for the applicants for serving the same upon the opposite party outside the Court.

List on 17.04.2026 as fresh.

On the next date, affidavit of service of notice upon the opposite party shall be filed by the applicants.
