Heard Ms. Sunita Dwivedi, learned counsel for applicant and Mr. Sanjay Kumar Verma, learned counsel for opposite party and perused the material available on record.

By means of the present Transfer Application filed under Section 24 of the C.P.C., the applicant has prayed for the following relief:-

"That for the facts and reasons and circumstances of the case which is dully supported by an affidavit this Hon'ble court may very kindly be pleased to pass an order to transfer the case no. 1814/2024 under section 9 of Hindu Marriage Act, 1956 filed as Ravindra Maurya Vs. Sunita Maurya from the court of Additional Principal Judge-7 Family Court, Unnao, in the interest of justice."

It is informed by learned counsel appearing for their respective parties that this matter was referred to the Mediation & Conciliation Centre of this Court vide order dated 27.11.2025 and in pursuance of said order, both the parties participated in mediation proceedings that culminated as successful mediation. The contesting parties in the said mediation proceedings have executed an agreement dated 16.04.2026, copy whereof is available on record along with report of Mediation Centre.

The terms and conditions of the aforesaid settlement, are being quoted herein below:-

A) That both the parties namely Sunita Maurya (First Party) and Ravindra Maurya (Second Party) have agreed to continue to live together with love, affection, giving due respect to each other and taking good care of each other as they are living together since last few months.

B) That both the parties have agreed to discharge their matrimonial

obligations/duties without any kind of misbehave or harassment of each other and each others' family members. The family members of the parties shall not make undue interference in the family affairs of the parties.

C) That the Second Party does not have any objection if TACL No. 281 of 2025 (Sunita Maurya Vs. Ravindra Maurya) is allowed and Case No. 1814 of 2024 pending before Additional Principal Judge-7, Family Court, Unnao is disposed off. Besides the above if any other case is filed between both the parties the same shall be withdrawn by concerned party in terms of this agreement.

D) That it is also agreed between the parties that neither they themselves nor any member of their respective families shall institute any case in the form of criminal or civil proceedings against each other or any of their relative or family members in future in respect of present dispute or any matter incidental thereto in any Forum/Court, and if any proceeding has already been initiated the same would get disposed of in terms of this settlement/agreement.

E) That both the parties shall be bound by the terms and conditions of this Settlement in strict sense. In case of any default, the party committing default shall be liable for playing fraud with the Court, hence for contempt of the Court.

7. By signing this Agreement the Parties hereto state that they have no claims or demands against each other with respect to TACL No. 281 of 2025 (Sunita Maurya Vs. Ravindra Maurya) and all disputes and differences in this regard have been amicably settled by the Parties hereto through the process of Conciliation/ Mediation.

Learned counsel appearing for their respective parties categorically submitted and prayed that since both the parties have amicably settled their dispute and entered into a written compromise, therefore, the instant transfer petition be disposed of at this stage in the light of the decision passed by the Hon'ble Apex Court in the case of Aparna Goyal versus Rakesh Goyal reported in 2009 SCC OnLine SC 199.

In the wake of the aforesaid development, since nothing remains to be adjudicated in this transfer application, therefore, the same is consigned to record being disposed of.
