The present application under Section 24 of C.P.C. has been preferred by the applicant for transfer of Case No. 2916 of 2024 (Amit Kumar Versus Smt. Richa) under Section 9 of Hindu Marriage Act, from the Court of Additional Principal Judge, Family Court No. 6, Lucknow to the equivalent jurisdiction at District Azamgarh.

Submission of the learned counsel appearing on behalf of the applicant is that the marriage between the applicant and the opposite party was solemnized on 22.03.2024 as per the Hindu rites and customs, however soon after her marriage, the applicant was subjected to physical and mental harassment by the opposite party and his family members, as such, the applicant left the house of the opposite party and since then, she is residing with her parents at Azamgarh. It is alleged that the opposite party deliberately filed a Matrimonial Case under Section 9 of the Hindu Marriage Act, 1955 at the Family Court, Lucknow, just to harass the applicant. It is also alleged that on account of serious threats from the opposite party and also due to the financial constraints as well as unavoidable personal difficulties, the applicant, being a lady having no source of income, is unable to attend the Court proceedings at Lucknow, which is approximately 270-300 Kms. away from Azamgarh, as such, she wants the transfer of the case from Lucknow to Azamgarh.
