Heard learned counsel for the applicant and perused the record.

This transfer application has been filed by the applicant under Section 24 of the Code of Civil Procedure seeking transfer of Regular Suit No.163 of 1997 (Ramju Vs. Ram Singar) filed permanent injunction pending before the Civil Judge (Senior Division), Ayodhya to the court of Civil Judge (Senior Division), Ambedkar Nagar.

Learned counsel for the applicant submits that a Regular Suit No.124 of 1997 (Ram Singar v. Moti Lal and others) was filed by the opposite parties in respect of the same property against the applicant at Ambedkar Nagar. Hence, two parallel proceedings were going on between the parties at two different places. Learned counsel for the applicant submits that Regular Suit No.124 of 1997 (Ram Singar v. Moti Lal and others) was instituted by the opposite parties in respect of the same property and as such, two parallel proceedings are continuing between the parties for the same subject matter. He submits that continuation of such parallel proceedings is likely to result in multiplicity of litigation and the possibility of conflicting judgments. He further submits that appropriate orders be passed to prevent such duplication of proceedings in the interest of justice.

In view of above, the matter requires consideration.
