The present anticipatory bail application has been filed seeking anticipatory bail in Case Crime No: 189/2025, U/S:-126(2), BNS (341 IPC) and U/S 3/5(3) UP Prohibition of Unlawful Conversion of Religion Act, P.S.- Panchperwa-District-Balrampur.

Heard learned counsel for the applicant and learned A.G.A. for the State.

Submission of learned counsel for the applicant is that the applicant has been falsely implicated in the present case and that two young brothers have been unnecessarily roped in. It is further contended that the applicant has no criminal antecedents.

Learned A.G.A., however, has opposed the anticipatory bail application and submitted that the prosecution case stands duly corroborated by the statement of the victim recorded under Section 183 of the Bharatiya Nagarik Suraksha Sanhita, 2023. It is further submitted that there are five independent witnesses who have supported the prosecution version.

Perused the record, so also the statement of the victim under Section 183 BNSS.

The learned Sessions Court, while rejecting the anticipatory bail application, has recorded the following findings:

" केसडायरी के अवलोकन से स्पष्ट होता है िक प्रश्नगत प्रकरण में प्राथीर्गण / अिभयुक्तगण पर यह आरोप है िक उनके द्वारा सहअिभयुक्त के साथ िमलकर वािदनी के साथ जबरदस्ती िववाह करने एवं जबरदस्ती उसका धमर् पिरवतर्न करने का प्रयास िकया जाना पीिड़ता ने अपने बयान अंतगर्त धारा 183 भा०ना०सु०सं० में कथन िकया है। राज्य की ओर से उपिस्थत िवद्वान िजला शासकीय अिधवक्ता द्वारा उत्तर प्रदेश असाधारण गजद 21 अगस्त 2024 प्रस्तुत कर तकर् प्रस्तुत िकया गया है िक मूल अिधिनयम की धारा 7 के स्थान पर, िनिम्निलिखत धारा रख दी जाएगी,

"7(1) भारतीय नागिरक सुरक्षा संिहता 2023 (अिधिनयम संख्या 46 सन् 2023) में अन्तिवष्ट िकसी बात के होते हुए भी इस अिधिनयम के अधीन समस्त अपराध, संज्ञेय और गैर जमानतीय होगें तथा सत्र न्यायालय द्वारा िवचारणीय होगें। (2) इस अिधिनयम के अधीन दंडनीय िकसी अपराध के अिभयुक्त व्यिक्त, यिद अिभरक्षा में हो, को जमानत पर तब तक नहीं छोड़ा जायेगा, जब तक िक- ( क) लोक अिभयोजक को, ऐसे छोड़े जाने के िलए जमानत के आवेदन का िवरोध करने हेतु अवसर न प्रदान कर िदया जाय, और ( ख) जहां लोक अिभयोजक जमानत के आवेदन का िवरोध करता है वहीं सत्र न्यायालय का यह समाधान हो जाने पर िक यह िवश्वास करने के युिक्तयुक्त आधार है िक यह ऐसे अपराध का दोषी नहीं है और यह िक जमानत पर रहने के दौरान उसके द्वारा कोई अपराध िकया जाना सम्भाव्य नहीं है।"

इस स्तर पर पत्रावली पर उपलब्ध प्रपत्रों/साक्ष्य से उक्त अपराध कािरत करने में अिभयुक्त की संिलप्तता प्रथम दृष्टया दिशत हो रही है। मामला अिभयुक्तगण के िवरूद्ध िववेचनाधीन है। प्रस्तुत मामले के सहअिभयुक्त महमूद शाह का िनयिमत जमानत प्राथर्ना पत्र पूवर् में िनरस्त िकया जा चुका है।

7. उभय पक्षों के तकों, प्रकरण के समस्त तथ्यों, पिरिस्थितयों एवं अपराध की गम्भीरता आिद को दृिष्टगत रखते हुए प्राथीर्गण / अिभयुक्तगण को अिग्रम जमानत पर िनमुर्क्त िकये जाने का पयार्त आधार नहीं पाया जाता है। तदनुसार उपरोक्त अिग्रम जमानत प्राथर्नापत्र िनरस्त िकए जाने योग्य है।

8. प्राथीर्गण / अिभयुक्तगण जमील अहमद, बादशाह आलम व िनसार अहमद द्वारा मुकदमा अपराध संख्या189/2025, अन्तगर्त धारा-126 (2) (341 भा०८०सं०) बी०एन०एस० व धारा-3/5(3) उ०प्र० िविध िबरुद्ध धमर् पिरवतर्न प्रितषेध अिधिनयम् धाना पचपेड़वा िजला-बलरामपुर के मामले में प्रस्तुत उपरोक्त जमानत प्राथर्नापत्र िनरस्त िकया जाता है।"

A perusal of the material available on record, including the statement of the victim under Section 183 BNSS, prima facie show that the victim has specifically alleged that the applicant, along with the co-accused, attempted to forcibly solemnize marriage with her and also attempted to forcibly convert her religion. At this stage, the complicity of the applicant in the commission of the alleged offences is clearly discernible.

In view of the seriousness of the allegations, the nature of the offence and the material collected during investigation, this Court is of the opinion that it

does not appear to be a case of false implication. No case for grant of anticipatory bail is made out.

Accordingly, the anticipatory bail application is dismissed .
