Heard Sri Shikhar Tandon, learned counsel for the applicants, Sri Jitendra Kumar, learned A.G.A. for the State and perused the record.

Sri Ashish Kumar Pandey, Advocate appears and submits that he has received instructions on behalf of the first informant today itself and he will file vakalatnama in a day or two.

The present application has been moved seeking anticipatory bail in Case Crime no. 307 of 2025 under Sections 318(4), 338, 336(3), 340(2), 353, 351(2), 61(2)ka of B.N.S., Police Station Kotwali, District Ghaziabad with the prayer that in the event of arrest, the applicant may be released on bail.

It is contended by learned counsel for the applicants that civil dispute has been given colour of criminality and as per the allegations in the FIR, applicant no.1 is said to have produced a forged receipt of tax from the Municipal Corporation.

On the other hand, learned A.G.A. has opposed the prayer for grant of anticipatory bail.

Considering the facts and circumstances and without expressing any opinion on the merits of the case, let the applicants Yameen and Smt. Rehana in the event of their arrest, be released on interim anticipatory bail on their furnishing personal bond of Rs. 50,000/- with two sureties each in the like amount to the satisfaction of the Court concerned till 22.1.2026 with

the following conditions :-

(i) The applicants shall not tamper with evidence and they would appear before the trial Court on the date fixed unless exempted by the Court concerned;

(ii) The applicants shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her/them from disclosing such facts to the Court or to any police officer;

(iii) The applicants would co-operate during trial and would not misuse the liberty of bail.

(iv) The applicants shall not leave India without prior permission of the Court concerned.

In default of any of the conditions, the prosecution shall be at liberty to file appropriate application for cancellation of the interim anticipatory bail granted to the applicants.

In the meantime, learned counsel for the first informant is directed to file vakalatnama as well as counter affidavit, if he so desires, by the next date fixed.
