Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.

This application under Section 529 BNSS has been filed seeking direction to the court concerned for early decision of Case No. 47 of 2015, (State Vs. Nitesh @ Munnu and others), arising out of Case Crime No. 73 of 2014, under Sections- 392, 411 I.P.C., Police Station- Belaghat, District- Gorakhpur, pending before the ACJM, Basgaon, Gorakhpur.

Learned counsel for the applicant submits that the trial has pending since 2015 and considerable time has already been lapsed.

Considering the facts and circumstances of the case and without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court concerned to decide the aforesaid case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of one year from the date of presentation of a certified copy of this order, if there is no other legal impediment.
