Allahabad High Court, Lucknow Bench (Divesh Chandra Samant, J.), March 10, 2026 — Application U/S 528 BNSS No. 936 of 2026: Sonu @ Virendra Yadav @ Virendra Kumar sought quashing of the summoning order dated 04.10.2025 issued by CJM Lucknow in Case No.117361/2025 (State versus Monu @ Narendra Yadav & others), arising out of Case Crime No.818 of 2024 under Sections 420, 506 & 120-B IPC, Police Station PGI, District Lucknow, together with charge sheet No.1 of 2025 and the entire criminal proceedings. Learned counsel for the applicant did not press the quashing prayer and confined the request to a direction that the court concerned decide the applicant's bail application in the light of Satender Kumar Antil v. Heard learned counsel for the parties and perused the record.

By way of the present application, the applicant made a prayer to quash the impugned summoning order dated 04.10.2025 issued by CJM Lucknow in Case No.117361/2025, (State versus Monu @ Narendra Yadav & others), arising out of Case Crime No.818 of 2024, under Sections 420, 506 & 120-B IPC, Police Station PGI, District Lucknow as well as impugned charge sheet No.1 of 2025 along-with entire criminal proceeding of the aforesaid case.

Learned counsel for the applicant does not want to press the prayer made in the application. He confines his prayer only to the extent that a direction be given to the court concerned to decide the bail application of the applicant in the light of the law laid down by the Apex Court in the cases of Satender Kumar Antil Vs. Central Bureau of Investigation , reported in 2021 (10) SCC 773 and Satender Kumar Antil Vs. Central Bureau of Investigation and others MANU/SC/0851/2022 .

Learned AGA as well as learned counsel for Opposite Party No.2 have no objection, if such a direction is given to the court concerned to decide the bail application of the applicant in the light of the judgments of the Apex Court in the cases of Satender Kumar Antil (supras).

Accordingly, it is directed that if applicant appear before the trial court and apply for bail then, his bail application shall be decided by the court
