Heard learned counsel for the applicant and learned A.G.A. for the State, and perused the material available on record.

It has been submitted by the learned counsel for the applicant that the applicant has been falsely implicated in the present case. The complainant is the wife of the applicant. It is submitted that she frequently used to go to her parental house and was not interested in residing with the applicant, and due to this reason a false F.I.R. has been lodged against the applicant and his family members.

It has further been submitted that there are material contradictions in the facts mentioned in the F.I.R. as well as in the medical report. Learned counsel for the applicant has further submitted that this Court has already stayed the further proceedings of the case against the co-accused persons by order dated 16.12.2025 passed in Application U/S 528 B.N.S.S. No. 2160 of 2025 ( Ramu Saroj and Another vs. State of U.P. and Another ).

A perusal of the F.I.R. shows that it has been alleged by the complainant that she was beaten by the accused persons on 29.06.2025 and was kicked out from her matrimonial home. It has further been alleged that she was abused and threatened by the accused persons. Thereafter, she went to her parental house where her father took her to the hospital and she was medically treated. However, the medical report submitted on record reflects that the complainant was medically examined on 06.06.2025.

Considering the submissions made by the learned counsel for the applicant, the matter requires consideration.

Notice on behalf of opposite party no. 1 has been accepted by the learned A.G.A.

Issue notice to opposite party no. 2, returnable within two weeks from today.

List this matter on 30.03.2026 in the daily cause list.

Till the next date of listing, further proceedings of Criminal Case No. 15066 of 2025 ( State vs. Ashok Kumar Saroj and Others ), arising out of Case Crime No. 0107 of 2025, under Sections 85, 115(2), 352 and 351(3) of the Bharatiya Nyaya Sanhita and Section 3/4 of the Dowry Prohibition Act, Police Station Kohandaur, District Pratapgarh, shall remain stayed so far as it relates to the present applicant.

In the meantime, learned counsel for the opposite parties may file their counter affidavits.

This matter shall not be treated as tied up or part-heard to this Bench.
