Ms. Vidyotma Kumari, Advocate has filed her vakalatnama today on behalf of opposite party no. 2, which is taken on record.

Heard learned counsel for the applicant, learned counsel for the opposite party no. 2, learned AGA for the State and perused the records.

The present application U/S 528 B.N.S.S. has been filed by the applicants with the prayer to quash the charge-sheet dated 03.06.2022, cognizance/ summoning order dated 08.07.2022 as well as entire proceedings of Special Case No. 689 of 2025 (State Vs. Danveer Pal), arising out of Case Crime No.065 of 2022, under Sections 363, 366, 376(2)(N) I.P.C. and Section 6 POCSO Act, Police Station Meerganj, District Bareilly, pending in the court of Special Judge (POCSO Act), Bareilly on the basis of compromise.

Learned counsel for the applicant and learned counsel for the opposite party no. 2 jointly submit that the parties have entered into a compromise and the applicant and victim got married and are residing together. They further submit that the compromise has been reduced to writing stating therein that they have entered into compromise and they do not want to press the case, copy of

said affidavits have been annexed as Annexure no. 3 to this application. Therefore, no useful purpose would be served in continuing the proceedings before the court below and the same is not only sheer wastage of time of the Court but also abuse of the process of law.

Learned AGA for the State submits that the compromise effected between the parties may be verified before the court concerned.

In the interest of justice, the applicant and the opposite party no. 2 are directed to appear before the court concerned along with a certified copy of this order as well as copy of the compromise deed within two weeks from today, which shall be verified by the court concerned and a report in this regard along with status of the trial shall be submitted before this Court within two weeks thereafter. While passing the order verifying the compromise, the concerned court shall also record the statement of the parties as to whether all the terms and conditions mentioned in the original compromise deed, so filed, have been fulfilled or not?

List this case on 30.03.2026 as fresh.

In the meantime, learned A.G.A. for the State may file counter affidavit.

Office is directed to return the certified copy of the compromise deed, if any, to the learned counsel for the parties after retaining photocopy of the same .

Till the next date of listing, further proceedings against the applicant in the aforesaid special case shall remain stayed.
