The applicant has filed the present application mainly with the following prayer:

"In view of the aforesaid facts, reasons and circumstances, it is most respectfully prayed that this Hon'ble Court may graciously be pleased to:

1. Quash the impugned summoning order dated 18.11.2024 (Annexure No. 1 to the application) Under section 144 of BNSS, (hereinafter referred to as the "impugned Maintenance case") bearing Case No. 2734 of 2024 in Re" Alveera Haider Versus Alamdar Hussain" pending before the LD. APJ-7, Family Court, Lucknow, and all consequential proceedings arising therefrom;

ii. Quash the impugned maintenance case (Annexure No. 2 to the application) Under section 144 of BNSS, bearing Case No. 2734 of 2024 in Re" Alveera Haider Versus Alamdar Hussain" pending before the LD. APJ-7, Family Court, Lucknow, and all consequential proceedings arising therefrom;

iii. Quash the entire consequential proceedings against the Applicant pursuant to the impugned maintenance case

Learned counsel for the applicant does not want to press this application at this stage and he wants to withdraw the case with liberty to file a fresh.

Learned A.G.A. has no objection to the prayer made by learned counsel for the applicant.

In view of the above, this application is dismissed as withdrawn .

Consign to records.

Office is directed to return certified copy of the documents annexed with the present application to the applicant/his counsel, after keeping a photocopy of the same on record. A Pen Drive has also been annexed as Annexure-7 to the application, which shall also be returned to the applicant/his counsel.
