Interlocutory order in an application under Section 528 BNSS seeking quashing of the entire criminal proceeding of Criminal Case No. 310 of 2017 (arising out of Case Crime No. 328 of 2013, charge sheet dated 23.02.2017 under Sections 420, 504, 506 IPC, P.S. Tappal, District Aligarh) and the summoning order dated 23.03.2017 passed by the Chief Judicial Magistrate, Aligarh, on the basis of a compromise dated 29.09.2025. Counsel for both sides jointly submitted that the dispute had been settled out of court and that O.P. No. 2 did not wish to proceed with the criminal case. The Court (Praveen Kumar Giri, J.) did not decide the quashing or stay prayers at this stage but directed both parties to appear before the trial court on 10.03.2026 for verification of the compromise application, directed the trial court to verify the compromise and send the verification report/order to the High Court, permitted the applicants' counsel to file the verification report with an affidavit, and listed the case fresh on 24.03.2026.

Heard Sri Saroj Kumar Tiwari, learned counsel for the applicants and Sri Manish Kumar Yadav, learned State Law Officer for the State.

Learned counsel for the applicants submits that he has filed the instant application under Section 528 BNSS with the relief which has been mentioned in the prayer clause of the application. The relief which has been mentioned in the application is delineated below:-

"It is, therefore, Most Respectfully prayed that this Hon'ble Court may kindly be pleased to allow this application and quash the entire criminal proceeding of criminal case no.310 of 2017 arising out of case crime no.328 of 2013 related to the charge sheet dated 23.02.2017 (State Vs. Smt. Manju Ram and others) under section 420, 504, 506 I.P.C., Police Station Tappal, District Aligarh as well as summoning order dated 23.03.2017, pending in the court of learned Chief Judicial Magistrate Aligarh on the basis of compromise dated 29.09.2025.

It is, further prayed that this Hon'ble Court may kindly be pleased to stay the further proceeding of criminal case no.310 of 2017 arising out of case crime no.328 of 2013 related to the charge sheet dated 23.02.2017 (State Vs. Smt. Manju Ram and others) under section 420, 504, 506 I.P.C., Police Station Tappal, District- Aligarh as well as summoning order dated 23.03.2017, pending in the court of learned Chief Judicial Magistrate, Aligarh on the basis of compromise dated 29.09.2025, during the pendency of present application before this Hon'ble Court, so that justice may be done, otherwise the applicants shall suffer irreparable loss

Learned counsel for the applicants as well as learned counsel for O.P. No.2 submit that the parties have resolved the dispute between them out of the Court and the O.P. no.2 does not want to proceed with the criminal case against the applicants. They further submit that some date may be fixed for their appearance before the trial court for verification of the compromise application.

In view of aforesaid submissions, both the parties are directed to appear before the trial court on 10.03.2026 for verification of the compromise application. Further, the trial court is directed to verify the compromise application on appearance of the parties before it and after verification of the compromise application, verification report/order shall be sent to this Court by the concerned trial court. Learned counsel for the applicants may also file the verification report along with an affidavit.

List this case on 24.03.2026 as fresh.
