At the very outset, learned counsel for applicant has submitted that both the parties have already been entered into a compromise but the same has not been preferred before learned court concerned since original copy of the same has been appended with this application. The said fact has not been disputed by Sri Vipin Gangwar, learned counsel for opposite party no.2.

Office is hereby directed to return the original copy of the compromise deed forthwith to learned counsel for applicant after retaining photocopy of the same on record.

Learned counsel for applicant is hereby directed to prefer the said compromise deed before learned Judicial Magistrate, Court No.3, Bareilly within 15 days from today.

In case, compromise deed is filed within the said period, learned Judicial Magistrate, Court No.3, Bareilly shall verify the said compromise in presence of both the parties within a period of four weeks and send its report to this Court through the Registry on or before the next date.
