At the very outset, learned counsel for applicants submitted that there is hardly any material available on record by which it can be said that offence under Section 117(2) BNS is made out but at the same time, learned AGA rebutted the stand taken up by learned counsel for applicant by way of submitting that it is apparent from the chargesheet that certain medical report is available and on the same basis, applicant was implicated for commission of offence under Section 117(2) BNS also.

Learned AGA is hereby requested to seek detailed instructions in the matter specifically over the issue that whether the injured was medically examined or not and if examined, medico legal examination report be produced before this Court on or before the next date of listing.

Put up this case on 24.03.2026 as fresh.
