Shri Rama Shankar Mishra, learned counsel for the applicant and Shri Puspraj Singh, learned brief holder for the State are present.

The present application under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicant to quash the order dated 20.8.2026 passed in Session Trial No. 442 of 2015, arising out of case crime No. 814 of 2014, under Sections 302, 120-B, I.P.C., Police Station- Kotwali Nagar, District Bulandshahr, whereby Adjournment Application has been dismissed, pending in the court of Additional Sessions Judge, court No. 2, Bulandshahr.

Learned A.G.A. pointed out that the case is listed for defence evidence from several dates since 5.5.2026 and more than 8 dates have been fixed in this regard, but no defence evidence has been produced by the present applicant as well as last opportunity to produce defence evidence has been granted and the case is listed for argument since 25.8.2026. It is further submitted that there is no stay with regard to proceeding of the aforesaid Session Trial passed by a Coordinate Bench of this Court in Criminal Revision No. 4329 of 2018.
