Heard learned counsel for the applicant, learned A.G.A. for the State, learned counsel for the opposite party No.2 and perused the record.

This application under Section 482 Cr.P.C. has been filed by the applicant to quash charge-sheet no. 895 of 2024, cognizance/summoning order dated 16.01.2025 as well as entire proceeding of Case No. 1145 of 2025 (CNR No. UPM004002440/2025) (State Vs. Rubi Kinnar and other), arising out of Case Crime No. 902 of 2024, under Sections 191(2), 115(2) and 352 BNS, Police Station Civil Lines, District Moradabad, pending in the court of learned C.J.M. Moradabad.

Learned counsel for the applicants submits that applicants and informant have reconciled their differences and a compromise has been entered between them, an original copy of compromise deed dated 22.08.2025 has been annexed as Annexure No.- 5 to this application. It is further submitted that there are two more cases pending before this Court, in which verified compromise deed has been sent to this Court, however, due to absence of any specific order of this Court, the compromise deed of the instant case could not verified before the trial court. Therefore, no useful purpose would be served in continuing the proceedings before the Trial Court and the same is not only sheer wastage of time of the Court, but also abuse of process of law.

Learned A.G.A. submits that it is the Trial Court, which has to verify the fact as to whether the parties have entered into a compromise.

Therefore, Office is directed to send the original compromise deed to the learned trial court i.e. Chief Judicial Magistrate, Moradabad for verification after retaining a copy of the same on record.

Both the parties are directed to appear before the court concerned within two weeks from today for verification of compromise and the court concerned is directed to verify the same.

After verification of compromise, a copy of the order of the Trial Court alongwith a copy of compromise duly verified by the Trial Court, be filed before this Court within one week, thereafter alongwith supplementary affidavit before this Court, so that further action may be taken thereon.

Till verification of compromise or for a period of one month, whichever is earlier, no coercive action shall be taken against the applicants in the aforesaid case.

List this case on 12.02.2026 along with the connected matters.
