The present application under Section 528 BNSS has been filed by the applicants Saurabh Singh, Shivam Chaubey, Harshit Chaubey, Deepak Upadhyay and Mahima Pathak , with the prayers to quash the summoning order dated 06.01.2025 in Criminal Complaint Case No. 717 of 2024, under Sections 323, 504, 354 IPC and Section 3(1)(da), 3(1)dha SC/ST Act, registered at P.S. Lanka, District Varanasi, pending in the court of Special Judge (SC/ST Act), Varanasi and with a further prayer to stay the further proceedings of the aforesaid case, during the pendency of the present application.

Counter affidavit dated 20.08.2025 of opposite party no.2 is on record. Learned counsel for the opposite party no.2 submits that he has not received any rejoinder affidavit to his counter affidavit till date.

Since there is no representation on behalf of the applicants to press this application U/s 528 BNSS even in the revised, the same is dismissed for want of prosecution.
