The present application has been filed to quash the summoning order dated 24.06.2025 as well as entire proceedings of Criminal Misc. Case No.752 of 2024 (Smt. Suman Vs. Kartik Kumar and others) Under Sections 12,14,16,18,22 of the Protection of Women from Domestic Violence Act 2005, Police Station Mahila Thana Nawabad, District-Jansi, pending in the court of Civil Judge (Junior Division)/F.T.C.(C.A.W.)/Judicial Magistrate, Jhansi, District-Jhansi.

Learned counsel for the applicant submits that it is a matrimonial dispute. Applicant No.1 is husband of opposite party No.2. After marriage, some dispute arose and opposite party no. 2 initiated proceedings under Sections 498-A, 323, 504, 506 I.P.C. and Section 3/4 D.P. Act against the applicants wherein the applicants have been summoned. Thereafter, the applicants challenged the summoning order by filing application under Section 528 BNSS No.8870 of 2026 and this Court vide order dated 27.02.2026 referred the matter to Mediation and Conciliation Centre and mediation is pending between the parties. It is next submitted that present dispute is between the same parties and since one proceeding is pending before the Mediation
